Land4Rent Corp. (“We” or “Us” or “Land4Rent”) respect your privacy and are committed to protecting your personal information as set out in this privacy policy (the “Policy”).

This Policy, as further informed and supplemented by the Terms of Service, outlines:

• how we collect, use, disclose, and protect the personal information of our website users (herein and under the Terms of Service “you” or “your” or “user” or “users”);
• the types of information we may collect from you or that you may provide (which are both considered forms of collection by us) when you access or use our website http://www.Land4Rent.com or our mobile application (together, the “Platform”) and/or our services (the “Services”) (both as defined in the Terms of Service); and
• our practices for collecting, using, maintaining, protecting, and disclosing that information.

We will only use your personal information in accordance with this Policy and the Terms of Service unless otherwise required under applicable law. We take physical and technological steps to ensure that the personal information that we collect about you is adequate, relevant, and not excessive. We collect, use, maintain, protect and disclose your personal information to provide you with access to and use of the Platform and the Services and as further outlined herein and in our related Terms of Service (which is consistent with this Policy and certain defined terms of which are directly incorporated into this Policy by reference).

Your personal information forms part of the Registration Data. You understand, acknowledge, and agree that you have read and reviewed the Terms of Service along with this Policy, including but not limited to how personal information as part of the Registration Data ultimately forms part of the Resultant Data, in anonymized and aggregated form, that forms part of Land4Rent’s Intellectual Property and is owned and used by Land4Rent at its sole option and discretion. Your personal information may also form part of the Operational Data and, as set out in the Terms of Service, it also ultimately forms part of the Resultant Data in the same manner.

What is Personal Information?

Privacy laws in Canada generally define ‘personal information’ (“personal information”) as any information about an identifiable individual, which includes information that can be used on its own or with other information to identify, contact, or locate a single person. Personal information does not include business contact information, including your name, title, or business contact information provided within that business information context or anonymized, aggregated information that cannot be used on its own or with other information to identify, contact or locate a single person.
This Policy applies to personal information we collect, use, or disclose about you:
As part of your access to and use of the Platform.
As part of your access to and use of the Services.
As part of the Operational Data and Registration Data.
In email, short message service (SMS), and other electronic messages between you and the Platform and with respect to the Services and your access to and use of the Platform.
Through any mobile and desktop applications you download from the Platform, through the Google Play Store or Apple’s App Store, or through  which provide dedicated non-browser-based interaction between you and this Platform. For greater certainty, if you use a Land4Rent mobile application accessed and downloaded by you through the Google Play Store or Apple’s App Store, for greater certainty, Google and Apple, as the case may be, are not responsible for any defects or performance issues with such mobile applications or responsible for providing you with any maintenance or support. Any such issues are to be directed to Land4Rent at customercare@land4rent.com.
When you interact with our advertising and applications on third-party websites and services if those applications or advertising includes links to this Policy.

Third Party Websites

The Platform and the Services may include links to third-party websites, plug-ins, services, social networks or applications. Clicking on these links or enabling those connections may allow the third party to collect or share data (including personal information) about you. If you follow a link to a third-party website or engage a third-party plugin, please note that these third parties have their own privacy policies and we do not accept any responsibility or liability for these policies nor does this Policy apply to such third party websites, unless otherwise expressly stated herein. We do not control these third-party websites, and we encourage you to read the privacy policy of every website you visit. You click these links to such third party websites at your sole risk. You may also provide Land4Rent information such as your name and email address through one of our advertisements hosted on a third party website. While this Policy will apply to how Land4Rent uses your information your provide to Land4Rent through such sources, be advised that such third party websites will also have their own privacy policies that will apply to your use of those websites and that Land4Rent takes no responsibility for or accepts any liability for those policies.

This Policy DOES NOT Apply to Information That:

• We collect offline that either does not contain your personal information or, if it does, contains your personal information from a source other than you who you granted certain rights with respect to the collection, use, and disclosure of your personal information which rights were, under applicable privacy laws, broad enough to include provision to Land4Rent for collection, use, and disclosure to the extent and within the confines of the permissions you granted to such source. Note this Policy does apply to our user verification process, our user intake forms, and any ways in which individuals with potential interest in our Services can provide us with their information so we can follow-up with them.  
• You provide to or is collected by any third party, through any application or content (including advertising) that may link to or be accessible from or on the Platform, except as otherwise provided in this Policy.

Changes to this Policy and the Terms of Service

This Policy and the Terms of Service may change from time to time and it is your responsibility to review both on a regular basis to identify and comply with such changes. Your continued use of the Platform or the Services after we make changes indicates that you accept and consent to those changes, so, as it is your obligation, please check this Policy and the Terms of Service periodically on the Platform for such updates.

Types of Information You Provide to Us and We Collect From You (all “Collection”)

We collect and use several types of information from and about you, including:

• Personal information, which we collect as part of the Registration Data when you create an Account and from time to time to provide you with access to and use of the Platform and the Services, and which we received from you if you are a Tenant under a Lease Agreement, and also includes when you access or use the Platform or the Services your internet protocol (IP) address used to connect your computer to the Internet. We provide an opportunity for any user to unsubscribe from or opt-out of contact for marketing purposes on an ongoing basis by using the unsubscribe mechanism at the bottom of our marketing e-mails or e-mailing us at customercare@land4rent.com.
• Business-related information, which forms part of the Registration Data but is not personal information, namely information that relates to your Account and is required for your access to and use of the Services and the Platform if you are an authorized representative of a legal entity that holds an Account with us, and, in such circumstances, such information includes further business-related information such as, but not limited to:
  • your title;
  • your duties;
  • the business address;
  • the business email address;
  • a certificate of good standing or other similar corporate documents;
  • your direct business telephone number; and
  • the general business telephone number.
• Other Non-personal information, namely information that does not directly or indirectly reveal your identity such as demographic information, or statistical or anonymized and aggregated information. For example, we may anonymize and aggregate personal information to calculate the percentage of users accessing or using a specific feature of the Platform. This also includes technical information such as your login information for your Account, browser type and version, time zone setting, browser plug-in types and versions, operating system and platform, or information about your internet connection, the equipment you use to access the Platform, usage details, and other similar analytical information.
• Non-personal details about your Platform interactions, including the full Uniform Resource Locators (URLs), clickstream to, through and from the Platform (including date and time), products you viewed or searched for, page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), methods used to browse away from the page, or any phone number used to call our customer service number.

All of the foregoing types of data will form part of the Resultant Data under the Terms of Service. Again, data that contains personal information, forming part of the Registration Data or Operational Data, is anonymized and aggregated before forming part of the Resultant Data as set out in the Terms of Service.

How Do We Collect Information About You?

We use different methods to collect your information, including through:

• Direct interactions with you when you provide it to us, for example, by filling in forms or corresponding with us by phone, video conference, e-mail or otherwise.
• User contributions. You may also provide information for us to publish or display on public website areas, areas that are accessible by all users of the Platform with an Account or for us to transmit to other users or to third parties generally outside of the Platform for use as part of the auction process. For example, if you have asked that we auction your lands as Auctioned Lands, you understand, acknowledge, and agree that the information for the auction process will be made fully public, primarily through advertisements, to draw as much interest to the auction as possible and agree to such use of information you have provided to Land4Rent for the auction process.
• Automated technologies or interactions as you navigate through the Platform. Information collected automatically may include usage details, including details of your visits to the Platform, including traffic data, location data, logs, and other communication data and the resources that you access and use on the Platform and for the Services, and information collected through cookies, web beacons, and other tracking technologies including information about your computer and internet connection, including your IP address, operating system, and browser type and information capturing how you navigate and use the Platform. • Third parties or publicly available sources, for example, our business partners.

Data Categories for Information Collected

The information collected on or through the Platform or the Services or otherwise provided to Land4Rent under the terms and conditions of a Lease Agreement (and those related thereto under the Terms of Service) falls into different categories of data as follows:

• Registration Data: The general information we require for you to register for an Account with us and access and use the Platform and the Services generally, as set out in the Terms of Service and this Policy, which in part includes, but is not limited to, personal information.
• User Data: This type of data includes information, documents, materials, data, and other content, in any form or medium, that is uploaded or otherwise received, directly or indirectly, from a user by or through the Platform or the Services, excluding the Registration Data and, for greater certainty, excluding any such information, documents, and materials that were, under the Terms of Service, provided by a user and conspicuously marked as confidential information under the terms and conditions of the Terms of Service.
• Operational Data: As referred to in the Terms of Service (which is further defined in any Lease Agreement), this is information, materials, and data that a Tenant must provide to a Landlord and Land4Rent under any Lease Agreement.

Again, for greater certainty, these types of data all form part of the Resultant Data once Processed by Land4Rent.

Information You Share Directly with Other Users

Information you directly transmit to other users on the Platform or through the Services is at your own risk. Please be aware that no security measures are completely perfect. Additionally, we cannot control the actions of other users of the Platform and the Services with whom you may choose to share your information, particularly in terms of what they do with that information. Therefore, we cannot and do not guarantee that unauthorized persons will not view your information. It is prudent to only provide other users with information on an as-needed basis and to limit the extent to which any such information shared is sensitive or confidential in nature.

Information We Collect Through Cookies and Other Automatic Data Collection Technologies

As you navigate through and interact with the Platform, as noted above with respect to automated technologies or interactions, we may use cookies or other automatic data collection technologies to collect certain information about your equipment, browsing actions, patterns and other activities with respect to the Platform and the Services. We may also use these technologies to collect information about your online activities over time and across third-party websites or other online services (behavioral tracking).

The information we collect automatically is statistical information that includes personal information, and we may maintain it or associate it with personal information we collect in other ways, that you provide to us, or receive from third parties. It helps us to improve our Platform and to deliver a better and more personalized service, including by enabling us to:

• Estimate our audience size and usage patterns.
• Store information about your preferences, allowing us to customize the Platform according to your individual interests.
• Speed up your searches.
• Recognize you when you return to our Platform.

The technologies we use for this automatic data collection may include:

• Cookies (or browser cookies). A cookie is a small file placed on the hard drive of your computer and you may adjust these within the individual browser you use for websites generally. When you access the Platform, you will be asked if you want to accept these or not. Not accepting cookies may limit the functionalities of the Platform and what you can access and use on the Platform.
• Flash Cookies. Certain features of our Platform may use local stored objects (or Flash cookies) to collect and store information about your preferences and navigation to, from, and on the Platform. Flash cookies are not managed by the same browser settings that are used for browser cookies. For information about managing your privacy and security settings for Flash cookies, visit the Flash player settings page on Adobe’s site.
• Web Beacons. Pages of our Platform and our emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit Land4Rent, for example, to count users who have visited those pages or opened an email and for other related Platform statistics (for example, recording the popularity of certain Platform content and verifying system and server integrity).

Third Party Use of Cookies and Other Tracking Technologies

Some content or applications on the Platform or forming part of the Services, including advertisements, are served by third-parties, including advertisers, ad-networks and servers, content providers, and application providers. These third parties may use cookies alone or in conjunction with web beacons or other tracking technologies to collect information about you when you use the Platform. The information they collect may be associated with your personal information or they may collect information, including personal information, about your online activities over time and across different websites and other online services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content. We do not control these third parties’ tracking technologies or how they are used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly.

How We Use Your Information

We use information collected, including any personal information:

• To provide you with access to and use of the Platform and the Services.
• To present the Platform and its contents to you.
• To provide you with information, products, or services, including the Services, that you request from us or agree we can send to you.
• To fulfill the purposes for which you provided the information or that were described when it was collected or any other purpose for which you provide it.
• To provide you with notices about your Account, including but not limited to expiration and renewal and payment and withdrawal information, information about auctions, and any other notices we deem necessary for your use of and access to the Platform and the Services.
• To carry out our obligations and enforce our rights arising from any agreements with you or to comply with legal requirements under applicable law.
• To improve the Platform, our services, including the Services, and for marketing or user relationships and experiences generally.
• To allow you to participate in interactive features, social media, or similar features on the Platform and forming part of the Services.
• To measure or understand the effectiveness of the advertising we display to you and other users and to deliver relevant advertising to you.
• In any other way we may describe when you provide the information from time to time as set out in the Terms of Service.
• For any other purpose with your consent.

We may use the information we have collected from you to enable us to display advertisements to our advertisers’ target audiences. Even though we do not disclose your personal information for these purposes without your consent, if you click on or otherwise interact with an advertisement, the advertiser may assume that you meet its target criteria.

Disclosure of Your Information

While certain information you provide will be disclosed for auctions to those users with an Account that can access the auctions or to the public at large for the advertisement of those auctions, with respect to the Resultant Data and any other information that does not identify any individual, we may disclose such information about our users without restriction.

We may disclose and/or transfer your personal information that we collect or you provide as described in this Policy:

• To our subsidiaries and affiliates.
• In accordance with applicable law, to a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution or other sale or transfer of some or all of Land4Rent’s assets, whether as a going concern or as part of bankruptcy, liquidation or similar proceeding, in which personal information held by Land4Rent about our users is among the assets transferred.
• To advertisers and advertising networks that require the information to select and serve relevant advertisements to you and others. We do not disclose data about identifiable individuals to our advertisers, but we may provide them with aggregate information about our users (for example, we may inform them that 400 men between 30 and 45 have clicked on their advertisement on a specific day). We may also use such aggregate information to help advertisers target a specific audience (for example, men in a specific location). We may make use of the personal information, in anonymized and aggregated form, we have collected from you to enable us to display our advertisers’ advertisement to that target audience.
• To third parties to market their products or services to you if you have not opted out of these disclosures. We contractually require these third parties to keep personal information confidential and use it only for the purposes for which we disclose it to them.
• To contractors, service providers, and other third parties we use to support our business (such as rental payment processors, analytics and search engine providers that assist us with improvement and optimization for the Platform and the Services) and who are contractually obligated to keep personal information confidential, use it only for the purposes for which we disclose it to them, and to process the personal information with the same standards set out in this Policy.
• To fulfill the purpose for which you provide it. For example, if you give us an email address in your Account and have lands that are set to form part of the Auctioned Lands in an auction, your request for such lands to form part of such auction authorize us to use your email address or other contact information in your Account in the advertisement of the auction both to the general public and to users with Accounts and other information necessary for the auction process.
• For any other purpose disclosed by us when you provide the information.
• For any additional purposes with your consent.

We may also disclose your personal information:

• To comply with any court order, law or legal process, including to respond to any government or regulatory request, in accordance with applicable law.
• To enforce or apply our Terms of Service or rights under other agreements.
• If we believe disclosure is necessary or appropriate to protect the rights, property, or the safety of Land4Rent, our users or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection.

Transferring Your Information

We may disclose and/or transfer your personal information that we collect or that you provide as described in this Policy to contractors, service providers, and other third parties we use to support our business (such as rental payment processors, analytics and search engine providers that assist us improvement and optimization for the Platform) and who are contractually obligated to keep personal information confidential, use it only for the purposes for which we disclose it to them, and to process the personal information with the same standards set out in this Policy.

We process, store, and transfer your personal information in Canada pursuant to applicable Canadian privacy legislation and this Policy.

By submitting your personal information or engaging with the Platform or the Services, you consent to this transfer, storage, or processing.

Choices About How We Use and Disclose Your Information

We strive to provide you with choices regarding the personal information you provide to us. We want to point out or have created mechanisms to provide you with the following control over your information:

• Tracking Technologies and Advertising. You can set your browser to refuse all or some browser cookies or to alert you when cookies are being sent. To learn how you can manage your Flash cookie settings, visit the Flash player settings page on Adobe’s website. If you disable or refuse cookies, please note that some parts of the Platform or the Services may not be accessible or may not function properly.
• Third-Party Advertising. If you do not want us to share your personal information with unaffiliated or non-agent third parties for promotional purposes, you will be able to opt out when creating an Account or by contacting customercare@land4rent.com.
• Promotional Offers from Land4Rent. If you have opted in to receive certain emails from us but no longer wish to have your email address used by Land4Rent to promote our own or third parties’ products or services, you can opt-out by using the “unsubscribe” function in such emails or by contacting customercare@land4rent.com.
• Targeted Advertising. If you do not want us to use information that we collect or that you provide to us to deliver advertisements according to our advertisers’ target-audience preferences, you can opt out by contacting customercare@land4rent.com.

We do not control third parties’ collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way.

Data Security

The security of your personal information is fundamental. We use physical, electronic, and administrative measures designed to secure your personal information from accidental loss and from unauthorized access, collection, use, alteration, and disclosure. We store all information you provide to us behind firewalls on our secure servers.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of the Platform or the Services, you are responsible for keeping this password confidential. We ask you not to share your password with anyone or allow anyone to access or use your password for any reason. We urge you to be careful about giving out information in public areas of the Platform, like message boards or through direct messages or other interactive areas of the Platform.

Unfortunately, the transmission of information via the Internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to the Platform. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Platform.

Data Retention

Except as otherwise permitted or required by applicable law or regulation, we will only retain your personal information for as long as necessary to fulfill the purposes we collected it for, including for the purposes of satisfying any legal, accounting or reporting requirements. Under some circumstances, including in the form of the Resultant Data, we may anonymize your personal information so that it can no longer be associated with you. We reserve the right to use such anonymous and de-identified data for any legitimate business purpose without further notice to you or your consent as it no longer constitutes personal information.

Accessing and Correcting Your Personal Information

It is important that the personal information we hold about you is accurate and current. Please keep us informed if your personal information changes. By law, you have the right to request access to and to correct the personal information that we hold about you.

You can review and change your personal information by logging into the Platform and visiting your Account profile page.

We may request specific information from you to help us confirm your identity and your right to access, and to provide you with the personal information that we hold about you or make your requested changes. Applicable law may allow or require us to refuse to provide you with access to some or all of the personal information that we hold about you, or we may have destroyed, erased, or made your personal information anonymous in accordance with our record retention obligations and practices or as part of the Resultant Data. If we cannot provide you with access to your personal information, we will inform you of the reasons why, subject to any legal or regulatory restrictions.

We will, otherwise, provide you access to your personal information, subject to exceptions set out in applicable privacy legislation.

Withdrawing Your Consent

Where you have provided your consent to the collection, use, and transfer of your personal information, you may have the legal right to withdraw your consent under certain circumstances. Please note that, if you withdraw your consent, we may not be able to provide you with a particular product or service, including the Services. We will explain the impact to you at the time to help you with your decision.

Changes To Our Privacy Policy

It is our Policy to post any changes we make to our privacy Policy on the Platform. It is your responsibility to monitor the Platform. Though it does not remove your onus to monitor the Platform, we may also provide notice to you either by email or when you next access the Platform or log into your Account.
We include the date the Policy was last revised at the top of the page. You are responsible for ensuring we have an up-to-date, active, and deliverable email address for you, and for periodically visiting the Platform and this Policy to check for any changes.
